Brazil court ends Stake’s temporary operating right
Stake can no longer rely on a court order to keep operating in Brazil. A federal regional court has suspended the decision that let it trade until 25 October 2026 despite the national gambling ban.
How it unfolded
A decree from President Luiz Inácio Lula da Silva banned all gambling from 25 September 2026. Judge Rodrigues dos Santos of São Paulo's 9th Federal Civil Court then allowed Stake to continue until 25 October – the only licensed operator given that right, which some called a de facto monopoly.
Judge Di Salvo of the higher Federal Regional Court suspended the ruling, pointing to the risk of "regulatory asymmetry". According to SBC News, the appeal most likely came from the Attorney General's Office (AGU) or the Federal Prosecutor's Office (PGR), which both support the decree.
- Gambling has been banned in Brazil since 25 September 2026.
- Stake's exemption to 25 October has been suspended.
- Licensed operators launched in 2024, many with five-year SPA licences.
- Congress and the Supreme Court will decide the ban's future.
What happens next
ANJL and IBJR, which represent most licensed operators, argue the ban undercuts multi-year licences. Congress and the Supreme Court may take the matter up after the presidential election cycle ends on 25 October 2026.
Our advice
Ontario's regulated market is far more stable, but rules still matter. Compare sports betting options and check the legal gambling age before you sign up.
